cvs -d:pserver:cvsanon@cvs.maptools.org:/cvs/maptools/cvsroot \
   checkout -r branch-3-9 libtiff

and it seems to work for me. I had a look at TIFFFetchData() and it seems fixed. Though I'm not certain this is the problem you were seeing.
