I believe such a file would be out-of-spec, and so there isn't a well defined correct way of handling it.

I agree, except if there's also the Indexed tag (tag 346, http://www.awaresystems.be/imaging/tiff/tifftags/indexed.html). In that case, the photometric specifies the palette colorspace, not the raster colorspace.

However, the Indexed tag is very little used, to the best of my knowledge. Even if it's there, the file does probably not make sense to the vast majority of readers.
